Terms and Conditions

A. Preamble

As the operator of Experiences, Genius Gentlemen offers the event programs described on the website under the name “VWGolf Challenge”. Please pay attention to these General Conditions, which you must accept at the time of registration and which will be available for online consultation. These General Conditions constitute the document governing the contracting of the services.

B. General Section

1. Conclusion of the Contract

1.1 By registering, the participant makes a binding offer to Genius Gentlemen to enter into the contract. After registration, Genius Gentlemen will send the participant written confirmation.

1.2 The participant is responsible for all contractual obligations of the registered participants for whom he/she made the booking, as well as for his/her own.

1.3 The participant must be at least 18 years old at the time of the event.

2. Payment

2.1 To finalize the registration, the participant must pay 100% of the experience fee within the deadlines indicated by Genius Gentlemen, depending on the remaining time before the event.

2.2 Prices are indicated in euros and include the legal VAT. Payment by bank transfer to the Genius Gentlemen account is only possible in EUR. In the case of transfers from abroad, the participant must bear the resulting costs.

2.3 If payments are not made or are not made in full by the agreed due dates, and the participant fails to pay even after a reminder with a deadline, Genius Gentlemen may terminate the contract.

3. Services/Prices

3.1 The contracted services are determined based on the descriptions on the website www.vwgolfchallenge.com

3.2 Before the conclusion of the contract, Genius Gentlemen may make changes to service descriptions at any time, which will be communicated to the participant before booking.

3.3 Genius Gentlemen is obliged to immediately inform the participant of any change or deviation in the service. If necessary, a rebooking or free cancellation will be offered.

3.4 In case of exceptional weather conditions, official orders, safety reasons, or other important reasons that could not be foreseen at the time of contracting, Genius Gentlemen has the right to adapt the event program to the modified conditions (e.g., changing vehicle models or tires) to ensure participant safety. These adaptations do not affect the agreed participation fee as long as they do not constitute a significant change to the booked event.

4. Compliance with Safety Regulations

4.1 Participants must follow the instructions of Genius Gentlemen staff during each event. The use of seat belts is mandatory in all events.

4.2 If a participant fails to comply with this provision despite prior warning from Genius Gentlemen staff, disregards safety rules, or behaves recklessly in a way that endangers other participants or property, he/she may be expelled from the event without any right to reimbursement of amounts paid. Any damages caused by the participant due to reckless behavior or failure to follow staff instructions will be borne by the participant. Participation in the experience is at the participant’s own risk.

4.3 During driving, there is an absolute prohibition of alcohol (0.0‰), drugs, and other toxic substances that may impair driving ability. Each participant must ensure through their behavior prior to the event that they meet these requirements. Genius Gentlemen has the right to exclude a participant if there is strong suspicion of alcohol, drug, or toxic substance consumption. In such cases, the participation fee will not be refunded.

5. Start of the Event / Cancellation Fees

5.1 The participant may withdraw from the event at any time before its start by notifying Genius Gentlemen (contact details at the end of the General Conditions). Withdrawal must be requested in writing.

5.2 If the participant withdraws or does not attend the event, Genius Gentlemen may charge the following cancellation fees:

  • in case of cancellation up to 45 days before the event: 25% of the registration fee
  • in case of cancellation up to 31 days before the event: 50% of the registration fee
  • in case of cancellation up to 14 days before the event: 75% of the registration fee
  • in case of cancellation up to 7 days before the event: 90% of the registration fee
  • in case of cancellation less than 7 days before the event or no-show on the event day: 100% of the registration fee

6. Insurance

6.1 The participation fee includes travel assistance insurance for each participant.

7. Withdrawal and Termination by Genius Gentlemen

7.1 If the minimum number of participants is not reached, Genius Gentlemen may cancel the event up to 2 weeks before its start. In this case, the participation fee already paid will be refunded immediately.

7.2 Genius Gentlemen may withdraw from the contract before the start of the event if extraordinary and unavoidable circumstances (adverse weather, force majeure, etc.) prevent contract fulfillment. In such cases, a new event date may be proposed or the full registration fee refunded.

8. Passports and Visas

8.1 The participant must ensure that his/her passport is valid for at least 6 months on the start date of the experience.

8.2 The customer is solely responsible for ensuring compliance with all legal, administrative, and health requirements necessary to enter the country where the event is held. This includes, among others, obtaining the required visa, passport validity, vaccination certificates, or any other documents required by the authorities of the destination country.

9. Data Protection

The personal data you provide will be processed and used electronically to the extent necessary for contract execution. All your personal data is processed in accordance with Spanish data protection law.

10. Consumer Dispute Resolution

10.1 Consumer dispute resolution: Genius Gentlemen is neither willing nor obliged to participate in dispute resolution proceedings before consumer arbitration boards.
